A very warm welcome to Sofza.com. The given T&C (Terms And Conditions) or also known as Terms of Service, determine your access and usage of the Sofza website. That would include each and every facility and information provided you on or through www.sofza.com (referred to as “the Site”).

Please read thoroughly our Terms and Conditions before using the Site. By the use of this Site or by consenting to the Terms and Conditions, you are bound by these Terms and Conditions and our Privacy Policy that is stated within, included herein by reference. In case, you do not wish to agree to your Terms & Condition or our Privacy Policy, you should not access or use the Site in any way. In order to gain more detailed information regarding the access or usage of the Site, you may access the required titles given within.

The Site is made available to users who are at least 13 years old and above. However, if you are underage i.e younger than 13 years of age, you may not use the Site or the services provided to you through Sofza. By the use of this Site, you are giving the warranty that you are of legal age to get involved in a binding contract and meet all of the related eligibility requirements.  In case, you fail to meet the given requirements, you are not allowed to use the Site or access any of its content.

Overview (Main terms, in a nutshell)

  • To make use of the services provided on Sofza, registration is not required.
  • Services at this Site may begin at the starting price of $30. However, starting prices of some services may vary as determined by the seller.
  • For the order to process further, the buyers are requested to pay the full price in advance. If they are unable to do so, at least 25% of the amount is required, otherwise, the order shall not be processed.
  • Your payment made to us is secure. However, if you’re not content with the service provided by the seller, you may request for a refund.
  • Orders are placed through the Order button that can be found on the top right corner or you can place an order by contacting us through email or chat.
  • Please go through our Purchasing section is given below, for fee and payment details.
  • The orders must be fulfilled by Sofza and cancellation of orders may not take place without a proper cause.
  • The payment mode is through the order page or through the invoices received in the corresponding chat/email.
  • All rights are granted to the buyers for the work delivered unless otherwise stated by the seller on an email/chat.
  • Note: Some orders may require additional charges (through Extras/invoices). For further information, you may refer to “Ownership” and “Commercial Use License” sections given below.
  • The right to use all the published delivered works remains with Sofza for marketing and promotion purposes.

Seller’s

Basics

  • Orders are placed through the Order button that can be found on the top right corner or you can place an order by contacting us through email or chat.
  • In addition, Buyers may be offered Custom Offers by the Seller.
  • In case of an order cancellation (for any particular reason), the buyers shall be fully refunded.
  • For paying any direct or indirect taxes, including any GST, VAT or otherwise, which may apply, Sofza is responsible, depending on residency or location. Seller’s comply and will comply at all times, with their obligations under income tax provisions in their jurisdiction. The prices given on the order page are inclusive of taxes and charges that may be applied to Sofza.

Stock Images

  • Orders that are eligible have the facility to use Stock Images.
  • “Stock Images Extra”, is an additional facility that allows Sofza to pick from an exclusive catalog of images for more efficiency.
  • Important: Each selected Stock Image may use only once. The selected image is supposed to pair with the particular delivered work only and not for a recurring use. The image file may not be distributed by Sofza to the Buyer or any third party.
  • Important: In case of cancellation of an order that used to comprise of a Stock Image Extra, its use shall also be canceled and no longer might it be available for use on the same order.
  • The stock image shall be purchased from our choice (that would be helpful with the given order) or on your choice of purchase. The Stock Image site/company holds all rights and ownership. Furthermore, it is responsible for all the Stock Images and their quality.
  • Whilst making use of Stock Images, you represent and warrant the following:
    • You may not sell, modify, re-use, re-sell, distribute, display, reproduce or make any other use of the Stock Images.
    • Stock Image(s) may not be used:
      • solely or without any content;
      • for pornographic, defamatory or other unlawful purposes;
      • as templates for creating multiple copies of the same order;
      • to enable sharing of the image file;
      • as logos, trademarks, services marks or any other branding or identifiers whatsoever.
    • If the used Stock Images feature a model along with sensitive or controversial content, a statement must be included that the image is strictly used for illustration purposes and with the consent of the featured model.
    • You are not allowed to downloading of a Stock Image for self-purpose.
    • You are in no way granted ownership or copyrights to Stock Images.

Shipping Physical Deliverables

Few of the services provided on Sofza are hand delivered (arts and crafts, collectible items, etc.) and additional charges may be applied on such deliveries. Shipping charges may be applied to both local (within the country) orders as well as for internationally (outside the country) placed orders.

  • Orders that include shipping costs must have physical deliverables sent to Buyers.
  • Shipping costs added to a order only pertains to the cost Seller’s require to ship physical items to Buyers.
  • Important: Upon orders that require being hand delivered, buyers will be asked to provide with a shipping address.
  • For all the shipping arrangements, Sofza is responsible, once the buyer provides the Site with a shipping address.
  • For any of the damage sustained to the goods during the shipping, Sofza is not responsible.
  • A tracking number is a put use to avoid disputes regarding shipping. Hence, we require entering the tracking number if available in the chat/email when delivering your work.

Printing Services

  • Few of the provided services on Sofza can be digitally printed and hand delivered (Business Cards, Canvas/Poster Prints etc.).
  • Important: Upon orders that require to be hand delivered, buyers will be asked to provide with a shipping address.
  • Printing Services are powered by Sofza itself or by VistaPrint and subject to VistaPrint terms of use, who shall be responsible for packing shipping, tracking, quality, and condition of items or their delivery. Sofza is not responsible for any damage sustained to the services during the shipping. You can contact the Customer Support Department of Sofza for further assistance here.
  • You may use the Printing Services for delivered work, to which you shall have each and every right, title, and interest entitled to you. However, such delivered work must not contain any illegal content and does not actually or potentially infringe or misappropriate the copyright, trademark, or proprietary or intellectual property right of any person. You can report any claims of copyright infringement DMCA@sofza.com (DMCA notices).
  • Buyer will receive a confirmation email containing a Printing Order ID as well as the specific details of the Printing Order, upon the completion of a Printing Order.
  • By using the Printing Services you hereby grant to Sofza and VistaPrint, a non-exclusive, worldwide, royalty-free sub-license to edit, modify, adapt, translate, exhibit, publish, transmit, copy, prepare derivative works from, distribute, perform, display and use any delivered work in order to perform the Printing Services.

Buyers

Basics

  • Orders are placed through the Order button that can be found on the top right corner or you can place an order by contacting us through email or chat.
  • The right to use all the published delivered works remains with Sofza for marketing and promotion purposes.

Purchasing

  • Using the Order Now button, buyers pay Sofza to place an order to form an order page.
  • Furthermore, the buyers have the facility for placing a Custom Order which addresses the particular buyer requirements and receives a Custom Offer from Sofza through the site or through Sofza Anywhere.
  • The three payment modes are through Credit Card, PayPal or Payoneer.
  • At the time of purchase where a buyer can review and accept the total amount liable to pay, the service fee is also added. This fee covers the administrative fees. As of June 2018, the current fee assessed to the total purchase amount is $2 on purchases up to $40 and 5% on purchases above $40. Service fee shall not be refunded on canceled orders.
  • On the default purchase/cost of any service from Sofza you will get three modification with no cost and if you still not satisfied with the work then you will be charged $10 for each modification. The modifications can be more than $10 as well, it all depends on the design work that you need. And if you choose the option of “Unlimited Modification” on initial then there would be no extra charge for the modifications till 20 times.
  • If you need the copyright file or also known as the source file, it has a cost of $50 each. It’s the fixed price for any kind of design work.
  • On the default purchase/cost of any service from Sofza you will get two design work to choose for your best and if you need additional design work in case you were not satisfied with the previous work then that will cost you $30 each. The additional design work can cost more than $30 as well, it all depends on the design work that you need. If you choose the option of “Show 3 to 4 more designs” on initial then there would be no extra charge for the additional design work till 10 times.
  • On the default purchase/cost of any service from Sofza, you only have a license to use that under “Personal Use License”. If you need to modify or do anything with the design work you will need a “Commercial Use License” and that license has a cost of $50 for each design work. It’s the fixed price for any kind of design work.
  • “Urgent” service has a cost of $50 each whereas the “Most Urgent” service has a cost of $100 each. The order that was marked as Urgent, the seller will have to submit the first draft work within 24 hours and the order that was marked as Most Urgent, the seller will have to submit the first draft work within 12 hours of the time period.
  • If in any case, the seller won’t be able to deliver within the given time frame of the order of Urgent or Most Urgent the payment of that Urgent or Most Urgent will not be taken and it will be refunded to the buyer.
  • In certain locations, we may allow Buyers to pay in local currency. Buyers should note, however, that the order’s local pricing is only a conversion of their original US$ price, and therefore local currency prices may vary in according to the current exchange rates.
  • For protection against fraudulence, unauthorized transactions (such as money laundering), claims or other liabilities, the credit card information is not stored; but allow our payment vendors to collect information for the purpose of collecting payments from Buyers on the Site or transferring payments to Sofza on the Site. We are not subjected to the payment information provided to our payment vendors, and this information is subject to the privacy policy applicable to the payment vendor. Taxes

In addition to the order price shown on the order page, buyers may be charged with indirect taxes (such as VAT or GST) depending on their residency, location and any applicable law.

Buyers consent that they are responsible to oblige with all tax requirements liable onto them, including but not limited to any obligation to deduct or withhold taxes. It is hereby made clear that each and every price and fee that is stated on the Site are the net amounts that must be paid to Sofza following any direct or indirect taxes, levy, withholding tax and/or deductions.

Orders

Basics

  • Your order will be created and given a unique Sofza order number (#SO), once payment is confirmed.
  • According to the service that was purchased and advertised on the order, Sofza will deliver completed files and/or proof of work using the chat/email.
  • The order status is placed under “Delivered” and later on is shifted to “Complete” and a rating is required from the buyer. If no request for modification is made within the 3 days of the order being “Delivered”, the order shall be automatically placed under “Complete”.
  • Buyers are requested to try and settle any issues that arise amongst themselves within the same chat/email for delivering your work. Failing to resolve the issue, the buyers are encouraged, for further assistance to contact the Sofza’s Customer Support department.

Handling Orders

  • The Sofza is notified by its team through email when a buyer places an order.
  • Buyers are required to go through the delivery detail before placing the order. If in any case you missed confirming the detail and you need your work more urgently than the prescribed delivery time (i.e mentioned on the Sofza order page) than the seller has the right to request an additional amount so that they can process your order by making it of the highest priority.
  • Sofza will send the order status as completed files and/or evidence of work using the chat/email to mark the order as Delivered.
  • For scanning all transferred files for viruses and malware, the buyer is responsible. Sofza shall not be responsible for any damages which might be caused due to site usage or use of content or files transferred.
  • Without any prior notice, the seller may cancel the order regardless of buyer’s consent.
  • In case, the delivered materials do not match the specifications sent to the seller at the beginning of the order process, the buyers are suggested to use the “Request Revisions” feature whilst the order is still marked as Delivered.

Reviews

  • Feedback reviews given by buyers whilst completing an order are a vital part of Sofza’s rating system. A review is a way of letting Sofza know of the buyer’s experience. Buyers are suggested to communicate with the seller for any concerns experienced whilst their order is being processed in regards to the services provided by Sofza.
  • The Site places the comments of the buyers on public display. Buyers have the choice not to leave with a comment but still rate the services nevertheless, as they please.
  • In a delivery message, the Work Samples of the delivered images and videos are sent to a buyer.
  • Providing a response as a review: Once the work is delivered, the buyer has three days to respond for the review (or 14 days for order with shipping). The order will be considered completed if no response is given within the response time period.

Disputes and Cancellations

Buyers are requested to try and settle any issues that arise amongst themselves within the same chat/email for delivering your work. Failing to resolve the issue, the buyers are encouraged, for further assistance to contact the Sofza’s Customer Support department.

Basics

  • The Customer Support handles the order cancellation on Sofza, if eligible.
  • According to the Terms and Conditions, filing a transaction dispute or reversing a payment through your payment provider or your bank is a violation. Doing so might get your account temporarily disabled to investigate further security violations.
  • Note: The funds will be ineligible for a refund due to our obligations towards the payment provider, once you have filed a dispute with your payment provider.
  • You are encouraged to contact us through the contact page to resolve the matter, in the event that a buyer or seller encounters an issue regarding the service provided in an order.
  • Sofza reserves all the rights to cancel orders or place funds on hold in case of any suspicions regarding deceit transactions made on the Site.
  • The buyer is subjected to full payment in order for the transfer and assignment of intellectual property and for any reason whatsoever, the delivery may not be used if payment is canceled.
  • In case of an order cancellation (for any particular reason), the buyers shall be fully refunded.
  • Requests for revisions can be made through the same chat/email whilst the order is still marked as Delivered hence, within a given time period.
  • Using the “Request Revisions” facility, in order to obtain further services from the seller beyond the agreed limitations, is prohibited.

Order Cancellations

  • In case of any dispute, the buyer and seller’s are encouraged to resolve the issue amicably.
  • In order for Sofza to cancel the order, firstly it shall be assessed by the Customer Support for any violations of the Terms and Conditions, general misconduct etc. You may refer below for Order specific eligibility.
  • Completed orders (or, where it can be applied, milestones) may be canceled, as a result of a review of our Customer Support team, up to 14 days after the order (or Milestone) is marked as complete.
  • If the service was delivered as the suggested description on the order page, orders are not eligible to be canceled only based on the quality of service/materials delivered by the seller.
  • Prior to contacting Customer Support, buyers are encouraged to use the same chat/email to address their requirements or designs regarding the service provided by their Sofza team. Customer Support will not be taking any action against Orders where the buyers have failed to inform the seller on the same chat/email regarding the service and will allow the seller to provide a design version first. Non-permitted usage of Sofza is strictly prohibited.
  • In case of any non-permitted usage of Sofza took place during an Order, after being assessed by our Customer Support team, may result in order cancellation. This includes, but is not limited to; misconduct, unlawful behavior, or any other violations of Sofza’s Terms and Conditions.
  • Sofza Customer Support has the right to cancel orders based on, but not limited to, the following factors:
  • Active Orders (before the order is delivered, the buyer submits his requirements to place the order)
    • In case, the seller does not respond within 24 hours the order is marked as Late.
    • Users are accused of misbehaving towards the other party through threats of personal attacks against each other.
    • As part of the Buyer requirements or the delivery by the seller, seller’s supply or include copyright/trademark infringing materials.
  • Delivered Orders (after the seller Delivers and before the order is marked as complete)
    • The seller reserves the right to extend the delivery deadline in order to complete the requested service without providing the final delivered service to buyers.
    • The seller delivers no files and/or proof of work related to the agreed-upon order requirements.
    • Note: The materials used if subjected to questioning will be reviewed by our Customer Support team.
    • By withholding the final delivery of services directly regarding the agreed requirements, the seller can request additional amounts, on or off the Sofza platform.
    • The Request Revisions facility is suggested not to be exploited by the buyers, in hopes of gaining more services than the agreed upon requirements.
  • Completed Orders (after the order is marked as complete and before the 14-day limitation)
    • Users who are accused of misusing the copyright/trademark infringing materials after investigations and with substantial proof.
    • Buyers who are accused of using the materials commercially without purchasing the commercial use rights.
    • Note: Terms of Commercial use is available on the order page and cannot be retroactively integrated once the order has been marked as completed for more than 14 days (i.e 2 weeks).

Refunds

  • Upon cancellation of an order, Sofza will automatically refund the amount you paid back to your payment provider.
  • The service fee shall not be refunded.
  • When the deposit refunds are made available by the payment provider, the Customer Support team can act on it. For prevention of deceit and misuse, a limitation has been placed on the number of times a user can request the payment provider for a refund from their account which is assessed by our Customer Support team. An additional fee is liable on such refunds.

User Conduct and Protection

Sofza allows people from around the globe to buy almost any Graphic Designing service they require at a reasonable price.

Sofza maintains a gracious, lively community, and a professional atmosphere. Users are suggested to keep that spirit while participating in any activity or extensions of Sofza. This section is regarding the code of conduct the users should follow whilst communicate with each other on Sofza.

  • For the sake of privacy protection, the identifications are kept anonymous. Asking for personal contact details to be in touch outside of Sofza in order to avoid or Sofza platform is not strictly prohibited.
  • In case any necessary exchange of personal information is needed to carry on with the service may be exchanged within the same chat/email.
  • Sofza does not take the responsibility of providing the buyer with the guaranteed assuredness of the services offered. You may refer to Customer Support to find a solution to the matter.
  • Sofza does not provide protection for users who interact outside of the Sofza platform.
  • All information and file exchanges must be done exclusively on Sofza’s platform or Sofza’s emails.
  • Inappropriate language or violent messages sent to users will not be put up with and may end with a ban on using Sofza.
  • The Sofza marketplace is open to everyone. Discrimination against any member based on gender, race, age, religious affiliation, sexual preference or otherwise is unacceptable and may end with a ban on using Sofza.

Orders

  • Orders that are in breach of Sofza’s Terms and Conditions consisting upon a replication of the pre-existing services may be reported to the Customer Support.
  • Sofza will take action to clear and complete notices of supposed copyright or trademark infringement. For more information, our Intellectual Property claims procedures can be reviewed here.

Reporting Violations

In case, you come across any material that may breach our Terms and Conditions, you are encouraged to report it to us through the proper mediums formed to tackle those issues as stated in our Terms and Conditions. Our Trust & Safety team assessed all the cases. For privacy protection of the individuals, the outcome of the inquiry is not shared. For more information, you can refer to our Privacy Policy.

Violations

Users may receive a notice to the breach of our Terms and Conditions or any user misbehavior accounted to our Trust and Safety team. A word of warning will be sent to the user’s email address.

Non-Permitted Usage

Adult Services & Pornography – Sofza does not allow any exchange of adult-oriented or pornographic materials and services.

Inappropriate Behavior & Language – Communication on Sofza should be pleasant, practical, and professional. Sofza expresses disapproval at harassment and hates speech towards others.

Phishing and Spam – Sofza takes the matter its members’ privacy matters very seriously. Privacy & Identity – You do not possess any right to distribute or share other people’s personal and classified information. Fraud/Unlawful Use – You are suggested to refrain from engaging in any illegal activities or wrong intentions using Sofza.

Abuse and Spam

Targeted Abuse – Targeted Abuse is heavily frowned upon at Sofza and it is recommended not to spread hate speech against any other user.

General Terms

  • Disagreements should be left to deal with by getting in touch with the Sofza Customer Support.
  • Sofza may apply modifications to its Terms and Conditions whenever necessary. When these changes are applied, Sofza shall update its Terms and Conditions given on this page.
  • You have given your consent that if you use Sofza after the date on which the Terms and Conditions have been updated, Sofza will consider your use as acceptance of the updated Terms and Conditions.

Ownership

Ownership and its limitations: Unless visibly stated or else on the order page/description, when the work is delivered, and subject to payment, the buyer is given all intellectual goods rights, including but not limited to, copyrights from the seller for the work delivered, and the seller hands over any and all ethical rights there. The delivered work shall be treated as work-for-hire under the U.S. Copyright Act. In cases, the delivered work does not meet the requirements of work-for-hire or when US Copyright Act does not apply, the seller expressly agrees to hand over to the buyer the exclusive rights of the delivered work. All transferring and assigning of intellectual goods to the buyer shall be subjected to entire payment for the order and the delivery may not be put to use if payment is canceled for any specific reason. For the shadow of a doubt, in customized work, the delivered work shall be the private property of buyer, and seller hands over all rights, title, and interest in the delivered work. Some orders (including customized work) charge additional amounts (through Extra/other Invoice(s) with our Payment provider) for a Commercial Use License. This refers to that if you purchase the order for personal use, you will own all rights you require for such use, and will not need the Commercial Use License. However, if you would like to use it for any other purpose that is may or may not be in association with any business, or other undertaking intended for profit, you will need to purchase the Commercial Use License through an Extra/other Invoice(s) and shall be more suitable for business use.

Seller reaffirms that whatever information they receive from the buyer, which is not public domain, shall be kept confidential and shall not be shared or used for any purpose whatsoever other than for the delivery of the ordered work to the buyer.

Moreover, users (both Buyers and seller) agree that unless they unambiguously specify otherwise, the material users willingly create/upload to Sofza, including order texts, photos, videos, user photos, user videos and any other information, including the display of delivered work, may be put to use by Sofza for marketing and/or other purposes.

Commercial Use License

By buying a “Commercial Use License” along with your order, the Seller grants you an everlasting, elite, non-transferable, worldwide license to use the bought delivery for Permitted Commercial Purposes. All intellectual property rights of the bought delivery are hereby handed over to you. “Permitted Commercial Purposes” means any business related use, such as, for example, advertising, creating web pages, promotion, etc., and firmly leave out any unlawful, morally wrong or derogatory intention. This License is subject to Sofza’s Terms and Conditions.
